Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the platform at www.grwhracing.eu ("Platform"), operated by Česká dostihová federace (Czech Racing Federation), IČO 70848475, with registered address at Liblice 81, 277 32 Liblice, Czech Republic, registered in the Register of Associations maintained by the Municipal Court in Prague, file ref. L 69625/MSPH ("we", "us", "our").
By creating an account or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
These Terms are concluded in English. Communication regarding the contract may be conducted in English or Czech.
Guest access to the Platform is free of charge. Subscriber features require a paid subscription as described in Section 4.
2. Definitions
- Guest — Any person who accesses the Platform without creating an account.
- User — Any person who creates an account on the Platform.
- Subscriber — A User with an active paid subscription.
- Content — Any data, text, images, or other materials uploaded to or generated on the Platform.
- Service — The greyhound and whippet racing information platform, including race results, statistics, pedigree data, advertising marketplace, and community features.
- Trial Period — The initial period after registration during which the User has full Subscriber access without charge.
3. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- One account per person. Duplicate accounts may be removed.
- You must be at least 15 years old to create an account.
Profile Claiming
During registration, you may be offered to claim an existing profile that was migrated from our previous system. Claiming a profile that does not belong to you is a violation of these Terms and may result in a hard reset of your account (see Section 13) and cancellation of your subscription without refund.
4. Subscription and Payment
- Plans: Monthly (3.99 €/month, billed per month) or Yearly (19.99 €/year, billed per year).
- Pricing: All prices are final. Česká dostihová federace is not a VAT payer (§6 of the Czech VAT Act).
- Payment: All payments are processed securely via Stripe. We do not store your payment card details.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled.
- Cancellation: You can cancel your subscription at any time through the Stripe billing portal (accessible from your account settings). Cancellation takes effect at the end of the current billing period.
- Refunds: No refunds are provided for partial billing periods, except where the right of withdrawal under Section 5 applies. Subscriptions cancelled due to fraudulent profile claims are not eligible for refunds.
- Subscription lapse: If your subscription becomes inactive (cancelled, unpaid, or expired), your advertising listings will be automatically unpublished and access to subscriber-only features will be restricted.
- Free Trial: New users receive a free trial period upon completing registration with valid payment details. The trial length is set at our discretion and displayed during sign-up. One trial per user; the trial is non-transferable. At the end of the trial, the subscription automatically converts to a paid subscription at the selected plan rate unless cancelled before the trial ends. You may cancel during the trial at any time through the billing portal; no charge will be made.
Contract Conclusion
The subscription contract is concluded through the following steps: (1) creating your account with your personal information, (2) selecting a subscription plan, and (3) providing valid payment details via Stripe. The contract is concluded at the moment Stripe confirms your payment method. Your free trial begins immediately, and Stripe will send you a confirmation to your email address.
Before completing payment, you may review and correct your information by navigating back to previous steps in the registration process. You may also cancel the process entirely at any point before payment.
These Terms are permanently available on our website. We do not separately archive individual contracts; your subscription details are accessible in your account settings and through Stripe's billing portal.
5. Right of Withdrawal
As a consumer entering into a distance contract, you have the right to withdraw from the subscription contract within 14 days of its conclusion without giving any reason, in accordance with Section 1829 of the Czech Civil Code and, for EU consumers, Article 9 of Directive 2011/83/EU.
To exercise this right, inform us of your decision by an unequivocal statement (e.g. email to ivo.widziolek@gmail.com). You may use the model withdrawal form below, but it is not obligatory.

Effect of Withdrawal
If you withdraw within the 14-day period, we will reimburse all payments received from you, subject to the deduction described below, without undue delay and no later than 14 days from the day we are informed of your decision. The reimbursement will be made using the same means of payment as your initial transaction.
Immediate access
By completing payment, you request that the Service be provided to you immediately during the 14-day withdrawal period. If you exercise your right of withdrawal after using the Service, we will deduct a proportionate amount corresponding to the Service provided up to the date you informed us of your withdrawal (§ 1834 of the Czech Civil Code).
Free Trial
If you withdraw during the free trial period, no payment has been made and no reimbursement is necessary. If you withdraw after the trial has ended and payment has been charged, the proportionate deduction described above applies.
6. Access Levels
Guest Access (no account required)
Guests can browse limited racing data, search for dogs and people, view public profiles, and access basic race results. Access to detailed pedigrees, full statistics, rankings, and testmating is restricted.
Registered User Access (free account)
Registered users without an active subscription have the same access as guests.
Subscriber Access (active subscription required)
Subscribers have full access to all platform features including: complete pedigree data, full race results and statistics, testmating, managing a public profile page, posting advertising listings, requesting dog assignments, managing dog photo galleries, and adding dogs to favourites.
Technical Requirements
The Platform requires a modern web browser with JavaScript enabled. No additional software installation is required.
7. User-Generated Content
- You retain ownership of Content you upload (photos, advertising listings, profile information).
- By uploading Content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make your Content available on the Platform for as long as it remains on the Platform.
- You are solely responsible for the accuracy, legality, and appropriateness of your Content.
- You must not upload Content that is illegal, offensive, defamatory, misleading, infringing on third-party intellectual property, or otherwise harmful.
- We reserve the right to remove any Content that violates these Terms without prior notice.
8. Advertising Listings
- Advertising listings (dogs for sale, litters) must contain accurate and truthful information.
- Contact information you provide in a listing (email, phone number) will be publicly visible.
- Listings are automatically unpublished if your subscription becomes inactive.
- The Platform serves only as a venue for listings. We are not a party to any transaction between users and bear no responsibility for the quality, safety, legality, or delivery of advertised dogs or litters.
9. Dog Assignment Requests
- Subscribers may request to be assigned as owner, trainer, or breeder of a dog on the Platform.
- All assignment requests require administrator approval.
- You may have a maximum of 10 pending assignment requests at any time.
- Submitting fraudulent or false assignment requests may result in account suspension or a hard reset of your account.
10. Intellectual Property
All Platform content not uploaded by users — including racing data, statistics, rankings, pedigree databases, software, design, and branding — is the property of Česká dostihová federace or its licensors.
- You may not scrape, crawl, reproduce, redistribute, or commercially exploit Platform data without our prior written consent.
- The Platform name, logo, and trademarks may not be used without our authorization.
11. Digital Service Conformity
In accordance with Sections 2389a–2389u of the Czech Civil Code (implementing EU Directive 2019/770 on digital content and digital services), you have the right to receive a Service that conforms to the contract.
Conformity Requirements
The Service must match the description, quantity, and quality specified in these Terms, be fit for the purposes for which a service of the same type would normally be used, and be supplied with any updates necessary to maintain conformity throughout the subscription period.
Liability Period
We are liable for any defect that becomes apparent during the continuous supply of the Service. A defect that appears within the first twelve months is presumed to have existed at the time the Service was first supplied, unless the nature of the Service precludes this.
Remedies
- You may first request that the defect be remedied within a reasonable time and without significant inconvenience.
- If the defect cannot be remedied, or if we fail to remedy it within a reasonable time, you may request a proportionate reduction in the subscription price.
- You may withdraw from the contract if the defect is not minor.
These rights are in addition to, and do not affect, any other remedies available to you under applicable law.
12. Limitation of Liability
- Nothing in these Terms excludes or limits the consumer rights described in Section 11 (Digital Service Conformity). Any provision that purports to do so is void to the extent prohibited by law.
- Racing results, statistics, pedigree data, and other information sourced from race events and third parties are provided without warranty as to completeness or accuracy. We strive for accuracy but cannot guarantee third-party data.
- We are not liable for any transactions, disputes, or losses arising between users through advertising listings.
- We are not liable for service interruptions, data loss, or technical failures beyond our reasonable control.
- To the maximum extent permitted by law, our total liability for any claim arising from your use of the Platform is limited to the amount you paid in subscription fees during the 6 months preceding the claim. This limitation does not apply to liability for intentional harm or gross negligence (§ 2898 of the Czech Civil Code).
13. Account Termination
- You may request deletion of your account at any time by contacting us at ivo.widziolek@gmail.com.
- We may suspend or deactivate your account if you violate these Terms.
- In cases of suspected fraudulent profile claims, we will notify you of the concern and provide a reasonable opportunity to respond. If the claim is confirmed, or if immediate action is necessary to prevent ongoing harm, an administrator may perform a "hard reset" which restores your account to its pre-registration state, cancels your subscription, and removes all personal data you provided.
- Upon termination, your access to subscriber features ceases immediately and your advertising listings are unpublished.
14. Complaint Handling
In accordance with Section 1811(2)(d) of the Czech Civil Code, we provide the following complaint handling procedure:
- Filing a complaint: You may file a complaint by email at ivo.widziolek@gmail.com or by post to our registered address. Please include your account email, a description of the issue, and the remedy you are seeking.
- Acknowledgement: We will acknowledge receipt of your complaint within 7 business days.
- Resolution: We will investigate and respond to your complaint within 30 days of receipt. If additional time is needed, we will inform you of the reason and the expected resolution date.
- Outcome: You will receive a written response detailing our findings and any remedy offered (e.g. service correction, price reduction, or refund).
If you are not satisfied with the outcome, you may pursue alternative dispute resolution as described in Section 16.
15. Changes to Terms
In accordance with Section 1752 of the Czech Civil Code:
- We may amend these Terms if the nature of our obligation reasonably calls for it (e.g. changes in legislation, new platform features, or changes to payment processing).
- We will notify you of any material changes before they take effect by placing a prominent notice on the Platform and updating the 'Last updated' date at the top of this page.
- You have the right to reject the proposed changes and terminate the contract before the new Terms take effect, without penalty. If your subscription is active, we will provide a pro-rata refund for the remaining unused subscription period.
- Continued use of the Platform after the new Terms take effect constitutes acceptance of the amended Terms.
16. Governing Law and Disputes
- These Terms are governed by the laws of the Czech Republic.
- We process all personal data in accordance with the GDPR, regardless of your country of residence, as our organisation is established in the EU (GDPR Article 3(1)).
- Any disputes shall be resolved by the competent courts of the Czech Republic.
- If you are a consumer residing in the EU, you retain the right to bring proceedings before the courts of your country of residence in accordance with EU Regulation 1215/2012 (Brussels I Recast).
- For EU consumers: you may find a list of dispute resolution bodies in EU Member States at consumer-redress.ec.europa.eu.
- The out-of-court alternative dispute resolution body competent for consumer disputes is the Česká obchodní inspekce (Czech Trade Inspection Authority), Štěpánská 796/44, 110 00 Praha 1, Czech Republic; www.coi.cz.
- If you reside outside the EU/EEA, these Terms are governed by Czech law. Where the laws of your country of habitual residence provide mandatory consumer protections that cannot be waived by agreement, those protections shall apply to the extent required by applicable law.
- If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
